Unincorporated Summit County STR Regulations
Unincorporated Summit County includes Copper Mountain, Tiger Run, Wildernest, Summit Cove, Peak 7, Peak 8, and many other mountain neighborhoods outside incorporated town limits. Short-term rental rules vary depending on whether a property is located in the Resort Overlay Zone (ROZ) or the Neighborhood Overlay Zone (NOZ).
Resort Overlay Zones (ROZ):
NO Cap on STR Type II licenses. Allows for 100% of properties to obtain STR license. There are no restrictions on nights rented or number of reservations. The Resort Overlay Zones include: Copper, Peak 8, and Tiger Run.
Neighborhood Overlay Zones (NOZ):
There are Type II and Type I exception license categorizations in the Summit County Neighborhood Overlay Zone. More information about the license types can be found at this link. Additionally, find more information regarding Overlay Zones here.
There is a cap on the number of type II licenses available and the number of bookings per year at each property. Each property will be capped at a maximum of 35 total bookings per year.
Unincorporated Summit County divides itself into four basins (Upper Blue, Lower Blue, Tenmile, and Snake River Basins).
As of July 16th, 2026: Upper Blue, Lower Blue, Snake River River Basins are accepting waitlist applications for Type II STR licenses. Click here for the latest Summit County Official STR Waitlist info.
New Type II licenses become available only when an existing license is relinquished, typically through a property sale (licenses are non-transferable) or when an owner chooses not to renew. Each basin maintains its own license cap and waitlist.
