Leadville Short-Term Rental Regulations

There are two classes of short-term rental licenses available in Leadville. “Class 1” Licenses are owner-occupied properties and “Class 2” Licenses are non-owner occupied. The Town of Leadville adopted an STR license cap which limits the number of Class 1 Conditional Use Permits for multiple licenses and Class 2 licenses issued to a total of 12% of the housing stock.

• A cap will be set on the number of certain licenses issued annually (from May 1 through April 30), equivalent to twelve percent (12%) of the total residential parcels in the City. The count of residential parcels will be determined by the City, using data from the Lake County Assessor.

• Only one short term rental (STR) is allowed per parcel. If a property owner wishes to rent out more than one STR on a single parcel, this will initiate a conditional use permit (CUP) process and will be counted towards the 12% cap, subject to the availability of licenses. For three or more licenses on one parcel, a Class 2 License is required, while a Class 1 License is needed for two or more licenses on one parcel.

• The sale or ownership transfer of a home will not include the STR license. Any license issued is non-transferable, either from one individual to another or from one location to another.

• All short term rentals must comply with the defined criteria in the code regarding habitable space and must possess all necessary building permits.
